In the latest developments regarding the legal proceedings involving Mr. Do Kwon, Co-Founder and CEO of Terraform, there are indications that plans for his extradition may involve the United States rather than South Korea.

The Wall Street Journal reported that individuals familiar with the matter have disclosed that Montenegro’s top justice official has privately suggested the possibility of Kwon being sent to the United States to face criminal charges rather than to South Korea.

This information comes in the wake of a Montenegro court’s approval of Kwon’s extradition to either South Korea or the U.S., as the requirements for the extradition have been satisfied, according to the court.

Interestingly, Kwon has filed an appeal against the extradition decision and expressed his refusal to accept the court’s decision. Local media reports claimed that since Kwon appealed, the Montenegrin Court of Appeals must reconsider the decision, as the appeal triggers a mandatory reexamination of the extradition ruling.

In related news, lawyers plan to take advantage of a related regulatory lawsuit to the ongoing case between the U.S. Securities and Exchange Commission (SEC) and Terraform Labs and Kwon.

The legal team notified the judge, in a recent filing, of the conduct of the SEC in its lawsuit against Digital Licensing. Reports revealed that a judge hinted at potential fines against the SEC, claiming that the SEC made deceptive statements in the lawsuit. The defendants claimed that this information was relevant as it questioned the SEC’s use of excerpts of evidence.
